EVE AI TERMS AND CONDITIONS

Please read these Terms and Conditions (“Terms”) carefully before using Eve AI (“the Service”), a service provided by Blue Skies Tech (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

  1. Acceptance of Terms
    By accessing or using Eve AI, you acknowledge that you have read, understood, and agree to be bound by these Terms, which may be updated from time to time. We will notify you of any material changes to these Terms by posting the updated Terms on our website or within the Service. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

  2. Description of Service
    Eve AI is an AI-powered service designed to provide personalized conversational experiences, assist with creative writing, generate ideas, and offer information across a variety of topics. The Service may be accessed through a web application and mobile app.

  3. User Accounts
    To access certain features of the Service, you agree to:

  • Provide accurate, current, and complete information during the registration process

  • Maintain the confidentiality of your account credentials

  • Be responsible for all activities that occur under your account

  • Notify us immediately of any unauthorized access or use of your account
    We reserve the right to suspend or terminate your account if we believe that you have violated these Terms.

  1. User Content
    You are solely responsible for the content you input into Eve AI (“User Content”). You represent and warrant that:

  • You own or have the necessary licenses, rights, consents, and permissions to use your User Content

  • Your User Content does not violate any applicable laws or regulations

  • Your User Content does not infringe upon the intellectual property rights of any third party

  • Your User Content is not defamatory, obscene, offensive, or otherwise objectionable
    We do not endorse any User Content and are not responsible for its accuracy or legality.

  1. Intellectual Property
    The Service and its underlying technology, including all software, algorithms, trademarks, logos, and other intellectual property, are owned by Blue Skies Tech or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use. You agree not to:

  • Reverse engineer, decompile, or disassemble the Service

  • Copy, modify, or create derivative works based on the Service

  • Distribute, sell, or sublicense the Service

  1. Privacy and Data Protection
    We respect your privacy and handle personal data in accordance with applicable laws. Our practices include:

  • Collecting only necessary information for Service provision

  • Implementing appropriate security measures

  • Transparent data collection and use policies

  • Respecting user privacy rights

  • Compliance with applicable data protection regulations

  1. Disclaimer of Warranties
    THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL DEFECTS WILL BE CORRECTED. WE MAKE NO GUARANTEES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE INFORMATION PROVIDED BY THE SERVICE.

  2. Limitation of Liability
    TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so some of these limitations may not apply to you.

  3. Indemnification
    You agree to indemnify and hold Blue Skies Tech harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Service, your User Content, or your violation of these Terms.

  4. Fair Use Policy
    While Eve AI provides unlimited access, we implement a Fair Use Policy to ensure reliable service for all users:

Acceptable Use includes:

  • Normal, regular interaction with the AI

  • Occasional high-volume usage within reasonable limits

  • Personal creative endeavors

Prohibited Activities include:

  • Automated or scripted interactions

  • Excessive continuous high-volume usage

  • Generation of spam or malicious content

  • Unauthorized commercial use

  1. Right to Revoke Access
    We reserve the right to suspend or terminate your access to the Service, either temporarily or permanently, if we believe you have violated these Terms or are engaging in abusive behavior.

  2. Data Protection and GDPR Compliance
    We comply with applicable data protection laws, including GDPR and the Privacy Act 2020. You have the right to:

  • Access your personal data

  • Request correction of inaccurate data

  • Request deletion of your data

  • Object to processing of your data

  • Request data portability

  1. Age Requirements
    You must be at least 13 years old to use the Service. Users under 18 must have parent/guardian permission to use the Service.

  2. Dispute Resolution

  • Disputes shall first be addressed through informal negotiation

  • If unresolved within 30 days, disputes shall be submitted to mediation in New Zealand

  • Parties shall share mediation costs equally

  • Legal proceedings may be pursued if mediation is unsuccessful

  1. Service Modifications
    We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We shall not be liable for any such modifications.

  2. Governing Law
    These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.

  3. Severability
    If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary while preserving the remaining provisions.

  4. Entire Agreement
    These Terms constitute the entire agreement between you and Blue Skies Tech regarding your use of the Service and supersede all prior agreements and understandings.
